The actress was convicted of Driving Under the Influence of alcohol (DUI) in 2007, and was ordered to complete alcohol education classes as part of her probation. The star was told she had to go to a class once every seven days, with Judge Marsha Revel telling her last year if she didn`t comply she would be incarcerated. If she was in rehab, the weekly class would be waived.
According to gossip website TMZ, the place where Lindsay takes the lessons is legally bound to tell the court if any student does not turn up for 21 days. "So here`s the disconnect: The school has not reported an attendance violation ... because Lindsay frequently waited until the 21st day to attend classes," the site reports. "Bottom line - Lindsay met the school`s requirement, but squarely violated the judge`s order." A progress hearing to discuss Lindsay is scheduled for May 20, but she doesn`t have to attend unless she`s not in compliance. TMZ claims to know what is going to be said in court, alleging Lindsay will be accused of "habitually violating" the court order to go to a class every seven days.
"We have received no negative written report from the program and contend Ms. Lohan is therefore in compliance," Lindsay`s lawyer Shawn Chapman Holley said, when asked for comment.
In February, Judge Revel gave Lindsay a good progress report. "Lindsay is in full compliance. Everything looks good," she said.
There has been intense speculation about Lindsay`s well-being in recent days, after her father Michael Lohan staged an intervention at her Los Angeles home to try to "save" the actress and her sister Ali. Michael alleges Lindsay is addicted to prescription medication, a claim she vehemently denies.
He insists she needs help with her problem, and is currently consulting a lawyer about getting a conservatorship over his daughter, or legally forcing her into rehab. A conservatorship would see Michael in charge of Lindsay?s personal and professional affairs.
Lindsay and her mother Dina Lohan have blasted Michael?s actions, insisting he is just trying to get publicity. The 23-year-old went on an American radio show earlier this week and described her father as "foul", adding she doesn`t know why people are so interested in her.
"I don`t know why I am such a target, but I think there`s a big misconception of who I am as a person," she said.
