Noel Gallagher has filed a defence against his brother The `Everybody`s on the Run` songwriter has submitted a 14-page document in response to the legal action the Beady Eye singer took over claims made by Noel that Liam had missed their former band Oasis` V Festival concert in August 2009 because he had a hangover.

Liam insisted in his case that he had been diagnosed with laryngitis which forced him to miss the group`s second headlining night, a fact Noel later acknowledged in a radio interview, which was believed to have brought an end to the row.

However, the guitarist filed a rigorous defence with the Queen`s Bench Division in London on November 1, making a string of counter accusations, which mean it is likely Liam is now expected to pursue his action all the way, and the pair could come face-to-face in court next summer.

In his counter claims, Noel says his "hangover" statement arose out of exasperation at Liam`s "generally irresponsible and unreasonable behaviour" over the years.

The papers, obtained by the Daily Mirror newspaper, state: "The claimant had a history over the years of not only throat problems and of pursuing such an incompatible lifestyle, but of treating Oasis fans and the defendant with disrespect by disrupting gigs, including walking off stage, assaulting them and generally acting irresponsibly."

Another point raised in Liam`s lawsuit claims Noel stated the demise of Oasis began when they had a argument over his wish to advertise his Pretty Green clothing range in the band`s `Dig Out Your Soul` tour programme, a claim Liam insists is false.

In his papers, Noel admits he had said Pretty Green would be allowed in the brochure "over my dead body," but claims he didn`t speak directly to Liam about it, and instead went through intermediaries.

He claims his refusal to allow the "free advertising" created such animosity between the pair it was a major factor in his decision to quit the band.

Noel also said how "the last straw" came at the show in Paris when Liam "completely lost control" moments before going on stage.

The papers Liam allegedly began "swinging a guitar around like an axe, nearly smashing the defendant in the face with it".

Liam has previously said of his decision to take legal action: "I tried to resolve this amicably but have been left with no choice but legal action. All I want is an apology."

A spokesman for the singer said last night (20.11.11): "After Noel apologised the matter is now in the hands of lawyers."
