Banks can be forbidden to raise interest rates for credits already taken by its clients
The Russian Procuracy has decided to deal closely with credit institutions breaking the civil code of the Russian Federation. The Krasnodar branch of VTB 24 was first to receive the instruction to correct infringements. There can be tens of banks next in turn on "the black list" of Procuracy.

Bankers appeal the right to raise interest rates unilaterally by the normatives of the Russian bank legislation. Within the last half a year about a quarter of the Russian banks changed credit interest rates. Basically tariffs of long-term programs on mortgages and credit cards were changed. Growth of percent was affected by complexities with refinancing of banks because of a credibility gap, accommodation prices fall (in case with mortgage).
Besides, banks have decided to secure themselves from growth of the delayed debts. According to experts now citizens owe to banks 160 billion dollars. Day by day the situation with payments worsens. Level of payment delay by physical persons to banks has already reached 10 %. Meanwhile the quantity of people dismissed during the crisis surpasses some millions, and real incomes of of those who has not lost it have dropped 1,5-2 times.
In January of this year deputies of the State Duma already considered possibility of a legislative interdiction for banks of unilateral reduction of validity period of credit contracts, increase of the interest rate or increase of commissions. However, discussion has been postponed "till the best times". Now situation with liquidity in banks has stabilised, and time to help borrowers has probably come.
According to analysts legality of credit rates increase at the moment depends on the crediting contract. If increase of rates is regulated in it - such measure is lawful. "However in Russia - laws are different to each other, - considers expert at Group of companies Aton Vladimir Neklidov. Interdiction of interest rates rising will depend on political will of our authorities, and the Procuracy will become its legal lever. If they want to soften social intensity in the country in this way, banks should abandon such increases of interest rates. In turn, bankers will shift risks of loan default on new borrowers, offering credit programs with new overestimated tariffs".
