European court of human rights in Strasburg proclaimed decision on case "Ilias Timishev against Russia".
Court recognized accusation of Timishev against Kabardino-Balkarian authorities grounded and enacted to collect 5950 euros from Russia.
Ilias Timishev ran away from Chechnya in 1996, when war has started, with his relatives and settled in Nalchik. In 1999 driving from Nazran to Nalchik, Timishev was detained at administrative frontier between Ingushetia and Kabardino-Balkaria. Traffic inspector, following oral instruction of Kabardino-Balkarian Ministry of Interior Affairs not to let Chechens to republic, turned him back.
In September Timishev`s children were not let in Nalchik school because they didn`t have official registration in Kabardino-Balkaria and document, confirmative status of refugees. Timishev explained that had to give migration card while receiving indemnity for lost property in Chechnya.
After investigation of the case European court declared that following articles of European convention were violated: article 4 of protocol 4, guaranteeing freedom of transportation, article 14, prohibiting national discrimination, article 2 of protocol 1, guaranteeing right on education.
Court noted that realization of right on children education, guaranteeing by national legislation, could not be determined by presence or absence of registration on place of residence.
