The arbitration Court of Khanty-Mansi Autonomous Okrug - Yugra declared illegal the fine of 35 thousand Rubles., imposed on the airline " UTair ", for violation of the procedure for informing of special services about the phone call with a bomb threat aircraft Ukrainian airlines, follows from released Tuesday of a court decision.

A call from a man named George began the call center of the airline on January 13. The caller first asked whether "UTair" Ukrainian airline, and then, receiving a negative reply, said of his desire "in connection with the events in Donbass to blow up a couple of" Ukrainian aircraft.

In accordance with Russian legislation, the carriers are obliged without delay to transmit data about the threatened acts of illegal intervention on the transport infrastructure to the competent authorities, and among them, the FSB, the interior Ministry and the Federal service for transport supervision, in accordance with special list.

However, UTair data in Rostransnadzor has not shown why the Ministry in the person of the territorial units of Gosavianadzor initiated an administrative proceeding and its results on February 26 that has brought the airline to punishment according to the administrative code and fined for 35 thousand Rubles.." UTair " appealed the fine in court.

Arbitration KHMAO, having considered the case under the rules of summary procedure, recognized airline guilty of the imputed administrative offences. But at the same time the Court determined that the decision imposing the fine was made by an unauthorized person - the Deputy chief of Department of Rosaviatsia. And at the same time legitimately this right is given only to the head of the Department.

The court of first instance annulled the decision to prosecute the airline to punishment according to the administrative code. The Agency has 10 days to appeal a judicial act, until not entered into legal force.
