Instead, when they arrived, the girl was placed in a psychiatric institution, where she was detained for a few days. The girl was detained in accordance with the EU legislation. Ireland adheres to the strictest abortion laws in Europe, backed by the eighth amendment of the Irish Constitution, which places the right to life of the unborn child the equal right to life of the mother.

The amendment adopted in 1983, prohibits abortion even in cases of rape, incest or poor health of the mother, that allows to consider an abortion only if the woman's life is in immediate danger in accordance with the Law on the protection of life during pregnancy in 2014.

The referring psychiatrist claimed that abortion was "not the solution to all problems of the child at this stage" and referred to the mental health Act - a law that may allow medical professionals to admit patients in psychiatric institutions without their permission. On Monday, the Irish campaign for the rights of abortion stated that it was "deeply concerned" that "the law (the law on the protection during pregnancy), which is designed to help pregnant people get the care, instead being used against them." A spokeswoman for the campaign for the rights of abortion Linda Kavanagh writes: "it's Hard not to think that the psychiatrist in this case essentially used the mental health Act as a tool to force the child to continue an unwanted pregnancy because of their personal beliefs.

After a few days the child was released from the psychiatric institution, after the district court ruled that she had "no mental disorder".
