Michael Jackson`s eyes will be used as evidence The pop icon died of acute Propofol intoxication by intravenous injection of another last June, and Murray has been charged with his involuntary manslaughter. He has admitted administering the powerful anaesthetic to help Michael sleep, with his hearing due to take place on June 14.

The physician insists nothing he gave Michael should have caused his death, and has claimed the singer injected himself with the lethal dose of Propofol.

Murray alleges he left Michael`s bedroom after treating him, and when he came back the star`s eyes were open and his pupils were dilated. According to gossip website TMZ, medical experts claim when someone dies of an overdose in their sleep their eyes would not be open.

"The defence position - Jackson woke up when Murray was out of the room, became frustrated he couldn`t sleep, grabbed the Propofol bottle and `pushed it` - killing himself," the site reports.

Murray`s legal team will reportedly try to convince the jury Michael`s eyes were open when he was found, therefore forcing them to question whether or not Murray administered the lethal dose of the drug.

Murray faced court on Monday, but his hearing was put off until the later date. On June 14, Superior Court Judge Michael Pastor is expected to schedule a preliminary hearing to determine whether Murray will face a full trial, and whether he can retain his medical licence.
